Given the foregoing, we need to verify your identity before accepting you as a client, and we need to use this information to effectively manage your trading account with us and ensure you receive the best possible service from us. We are subject to relevant laws and statutory requirements (such as anti-money laundering laws, financial services laws, corporate laws, privacy laws, and tax laws), and are subject to various legal obligations. Furthermore, we are subject to the laws and regulations of various regulatory bodies, such as the Financial Services Commission. These obligations and requirements require us to perform necessary personal data processing activities for credit checks, identity verification, payment processing, compliance with court orders, tax laws or other reporting obligations, and anti-money laundering controls.
These obligations apply at different times and include system checks for client onboarding/acceptance, payments, and risk management.
3. To Safeguard Legitimate Interests
We process personal data to safeguard our legitimate interests or those of a third party. Legitimate interests mean that we use your information for business or commercial reasons. 9. Investigating or Resolving Queries or Disputes
We may need to use the personal information we collect from you to investigate questions and/or resolve disputes with you, as it is in our legitimate interest to ensure that questions and/or disputes are investigated and resolved promptly and efficiently.
10. Complying with Applicable Laws, Court Orders, Other Judicial Process, or the Requests of Any Applicable Regulatory Authority
We may need to use your personal information to comply with any applicable laws and regulations, court orders or other judicial process, or the requests of any applicable regulatory authority. We do this not only to comply with our legal obligations, but also because it may be in our legitimate interests.
11. Sending You Surveys
From time to time, we may send you surveys as part of our customer feedback process. It is in our legitimate interest to solicit such feedback to ensure that we provide the highest standards of service and products. However, we may also invite you to participate in other surveys from time to time. If you agree to participate in other surveys, we will use the personal information we collect for such surveys with your consent. All responses to any survey we send, whether or not for customer feedback purposes, will be aggregated and de-personalized before the results are shared with any third party.
12. Data Analytics
Our website pages and emails may contain web beacons, pixel tags, or any other similar data analytics tools to enable us to track the receipt of our communications and count users who have visited our pages or opened our communications. We may aggregate your personal information (such as transaction history) in an anonymized form (i.e., removing your personally identifiable information) with the personal information of our other customers to enable more rigorous statistical analysis of general patterns, thereby helping us provide better products and services.
If your personal information is fully anonymized, we do not need a legal basis to do so, as it no longer constitutes personal information. If your personal information is not anonymized, we have a legitimate interest in continually evaluating it to ensure that the products and services we offer meet market demand.
13. Marketing Purposes
We may process your personal information to send you marketing communications via email, telephone, or other agreed-upon methods (including social media campaigns) to ensure you stay up to date with our latest products and services. If we send you marketing communications, we do so based on your consent or for our legitimate interests.
We will not disclose your information to any external parties to allow them to market directly to you.
14. Internal Business Purposes and Recordkeeping
We may need to process your personal information for internal business and research purposes, as well as for recordkeeping purposes. This processing is in our legitimate interests and necessary to comply with our legal obligations. This may include any communications between us and you regarding the services and products we provide to you and our relationship with you. We will also keep records to ensure compliance with your contractual obligations under the agreement governing our relationship with you.
15. Legal Notices
We are often required by law to inform you about certain products or services or changes to the law. We may need to inform you of changes to the terms or features of our products or services. We need to process your personal information to send you these legal notices. Even if you choose not to receive direct marketing communications from us, you will continue to receive such communications from us.
16. Corporate Reorganization
If we undergo a corporate reorganization, or if part or all of our business is acquired by a third party, we may need to use your personal information in connection with the reorganization or acquisition. This use may involve sharing your information as part of due diligence or disclosure under legal agreements. We have a legitimate interest in using your information in this way, subject to compliance with any legal/regulatory obligations we have to you.
17. Physical Security
If you enter any of our premises, we may record your image via CCTV for security purposes. We may also collect your information to keep a record of who enters our premises on any given day. We do this in our legitimate interest in maintaining a safe and secure work environment.
The Company will not disclose any of its clients' confidential information to third parties except: (a) as required by any applicable law, rule, and/or regulation; (b) where disclosure is required to the public; (c) where disclosure is in our legitimate business interests; or (d) at your request or with your consent, or to the persons described in this Policy. Unless otherwise directed by a regulatory authority, the Company will endeavor to make such disclosures on a need-to-know basis. In such cases, the Company will notify the third party of the confidential nature of any such information.

- Any other person authorized by you.
If the Company discloses your personal information to commercial parties (e.g., card processing companies or banks) in order to perform services requested by clients, such third parties may store your information to comply with their legal and other obligations.
Generally, we require organizations outside the Phyxtrade LTD group to confirm the confidentiality of personal information when processing or accessing it, to respect the privacy rights of any individual, and to comply with all relevant data protection laws and this Privacy Policy. Third-party service providers (such as credit reference agencies), where applicable, may record any searches conducted on our behalf and may use search details to assist other companies in conducting searches. Please note that the use of your personal information by external third parties acting as data controllers is not governed by this Privacy Policy or our privacy standards and procedures.
You acknowledge and agree that the Company may, from time to time, analyze data collected from visits to our website or through other means (such as surveys) for statistical purposes and to improve the Company's business activities.

You can ask us to stop processing your personal data, and we will do so if:
- We process your personal data based on our legitimate interests or those of others, unless we can demonstrate compelling legitimate grounds for the processing;
- We process your personal data for direct marketing; or
- We process your personal data for research, unless we reasonably believe that such processing is necessary for a matter of public interest (e.g., for a regulator or law enforcement agency).
Automated Decision-Making and Profiling
If we make a decision about your use based solely on an automated process (e.g., through automated profiling) that affects your use of the Services or otherwise impacts you, you may request not to be subject to such a decision, unless we can demonstrate to you that the decision was necessary for entering into or the performance of a contract between us. Even if the decision is necessary for entering into or the performance of a contract, you may object to the decision and require human intervention. If we agree to such a request (for example, ending our relationship with you), we may not be able to provide you with our services or products.
If you do not want us to use your personal information, you must notify the Company by emailing support@phxyus.com. If you decide to do so, we may not be able to continue to provide the information, services and/or products you have requested, and we will not be liable for this.
The Company may disclose your personally identifiable information as required by rules and regulations, or if the Company believes disclosure is necessary to protect our rights or comply with other litigation, court orders, legal process served on or by governmental, intergovernmental, or other regulatory bodies. The Company assumes no responsibility for the misuse or loss of personal information, or for other information not accessible or controlled by the Company website. The Company will not make any unlawful or unauthorized use of your personal information (whether or not permitted or authorized by our legal relationship) due to misuse or misuse of your password, negligent or malicious intervention, or by you or by your actions or omissions or by persons authorized by you.
To adapt to changing laws, regulations, technologies, and our operations, our Privacy Policy will be updated from time to time to ensure it remains relevant in this evolving environment.
If we decide to update our Privacy Policy, we will reflect this in this Privacy Policy and post it elsewhere as necessary so that you are aware of what information we collect, how we use it, and under what circumstances it may be disclosed.
If you have any concerns about our privacy policy, you can file a complaint. We will take prompt action. To file a complaint, please email support@phxyus.com.
